The Office of the State Superintendent submitted a waiver request to the United States Department of Education Food and Nutrition Service to delay the compliance date for the Streamlining Program Requirements and Improving Integrity in the SFSP Final Rule. OSSE is submitting this waiver to ensure integrity when implementing the updated regulations.

OSSE’s Division of Health and Wellness is submitting statewide waivers to the Mid-Atlantic Regional Office (MARO) for the Summer Food Service Program (SFSP) flexibilities and policies that were rescinded by the USDA Food and Nutrition Services (FNS) through SFSP 01-2019 Summer Food Service Program Memoranda Rescission. The following areas have been submitted for consideration:
- Policy waiving limitation of offer versus serve to school sponsors to allow all sponsors to implement this meal service model.
The goal of these waivers is to reinstate the rescinded flexibilities and policies to allow for efficient and cost-effective program management and reduce the administrative burden for sponsoring organizations and the D.C. State agency staff. Information regarding the approval or denial of these waiver requests will be posted here and will be provided to all sponsors and school food authorities via email once the USDA makes the determination.

The Office of the State Superintendent of Education (OSSE) submitted a request to the Mid-Atlantic Regional Office (MARO) for the Child and Adult Care Food Program and the Summer Food Service Program to waive certain State agency and sponsor monitoring requirements in an effort to eliminate interruptions to monitoring activities in the event of public health related events. Information regarding the approval or denial of these waiver requests will be posted here and will be provided to all sponsors via email once the USDA makes the determination.
OSSE was approved to implement this waiver.

The Office of the State Superintendent of Education’s Division of Health and Wellness is submitting statewide waivers to the Mid-Atlantic Regional Office (MARO) for the Summer Food Service Program (SFSP) and the Seamless Summer Option (SSO) flexibilities and policies that were rescinded by the USDA Food and Nutrition Services (FNS) through SFSP 01-2019 Summer Food Service Program Memoranda Rescission. The following areas have been submitted for consideration:
- Waiver Request 1 – Policy waiving first week SFSP site visits for returning sites. that operated successfully the previous summer with no serious deficiencies.
- Waiver Request 2 – Policy waiving meal time restrictions for SFSP and SSO - the minimum amount of time that must pass between meals and snacks and the length of meal service.
- Waiver Request 3 – Policy extending area eligibility to closed enrolled SFSP and SSO sites
The goal of these waivers is to reinstate the rescinded flexibilities and policies to allow for efficient and cost-effective program management and reduce the administrative burden for sponsoring organizations and the D.C.
