Every year, as required by federal law, OSSE examines data to determine if significant disproportionality, significant discrepancy and disproportionate representation is occurring in the state and its local education agencies (LEAs). These requirements are referred to as Equity Requirements under IDEA.

[1] To gradually implement multi-year flexibilities, for the 2020-21 school year review, OSSE will identify LEAs that were identified as having a significant discrepancy and/or disproportionate representation for the 2020-21 school year only. For the 2021-22 school year review, OSSE will identify LEAs that were identified as having significant discrepancy and/or disproportionate representation two consecutive years in the same analysis category. Beginning in the 2022-23 school year, OSSE will only flag LEAs that are identified in the same analysis category for three consecutive years. This will align with OSSE’s current year of data used for significant disproportionality.
