Please see the attached memorandum, released recently by USDA Food and Nutrition Services (FNS). In regards to accommodating students in the child nutrition programs, rather than focusing on whether or not a student has a disability, schools should focus on working collaboratively with parents to ensure an equal opportunity to participate in the School Meal Programs and receive program benefits. The attached memorandum clarifies changes made by the ADA Amendments Act and reflects the position FNS and OSSE will take in compliance reviews and enforcement actions.

USDA will be providing additional resources and guidance on implementing modifications to accommodate disabilities in the school meal programs. We anticipate this to include a webinar and question and answer resource guide. OSSE will share all resources as soon as they become available.
