Special Education Provider Payment Process Update

On November 1, 2012 the District of Columbia regained full responsibility for the payment and dispute process regarding payments for special education services funded by the District of Columbia provided by nonpublic special education schools and related service providers. On October 4, 2012 the Federal District Court for the District of Columbia approved a joint motion filed by the District and counsel representing the parties in Petties v. District of Columbia.

The timing for payments, invoice submission and processing remains the same. The invoice submission dates of the 5th and the 15th day of each month, remain the same as well. The dispute process provides for an opportunity for a hearing at the District of Columbia Office of Administrative Hearings. Details with regard to timing and opportunity for dispute resolution through mediation or a hearing will be described in notices of dispute issued by the Office of State Superintendent of Education, and are set forth in detail in OSSE  regulations attached hereto, under Title 5, subtitle A, chapter 29.
